TERMS OF SERVICE

These terms cover your use of chromedrxp.com and anything you buy from it. By using the site or placing an order, you accept them.
The site is operated by Chrome Drxp. Where these terms say we, us, or our, that is who they mean.
1. What we are
Chrome Drxp is a curated shop.
We select pieces from third-party manufacturers and suppliers, photograph and style them, and present them under our own catalogue names. We are not the manufacturer of the items we sell and we do not present ourselves as one.
We are based in Australia. Stock is held and dispatched by our suppliers in Shenzhen, China, which is why delivery takes longer than a domestic order and why a multi-piece order can arrive as separate parcels. The shipping policy sets out what that means for timing.
2. Intellectual property
Two separate things, and it is worth keeping them apart.
Ours. The Chrome Drxp name and marks, the site design and code, our photography, our styling, our catalogue names, and the writing across this site belong to us. You may not copy, reproduce, or use any of it commercially without written permission from us.
Not ours. Any trademark, design right, copyright, or other intellectual property in a manufactured garment belongs to whoever holds it. Nothing on this site is a claim to own the design of a piece we did not design. Naming a piece in our catalogue is a naming convention for our own shop and nothing more.
Buying an item transfers ownership of that physical item to you. It does not transfer any intellectual property rights in it, ours or anyone else's.
If you hold rights and think we are infringing them, email chromedrxpshop@gmail.com with the listing, what you own, and the basis of the claim. We will take the listing down while we look into it. We would rather remove a piece than argue about one.
3. Products and how they look
We photograph everything ourselves and we do not retouch a garment into something it is not.
Screens still differ. Colour on your phone will not match colour on a laptop, and neither will match daylight. Measurements are taken by hand and can vary slightly between units of the same piece.
Where a listing gives a measurement, that measurement is what we have verified. We do not publish fabric weights, compositions, or fit claims we have not confirmed with the supplier. If a listing is silent on something, that is because we do not know it yet, not because we are hiding it. Ask and we will find out.
4. Pricing and currency
Our prices are set in US dollars.
Where we support your local currency, prices display converted into it and you are charged in it. The rate is the one applying at the moment you check out. Whichever currency you are being charged in, it is shown next to the price before you pay. If you are ever unsure what you are about to be charged, the checkout page is the number that counts.
Your bank may still add its own conversion fee on top. What lands on your statement can differ slightly from what you saw at checkout, and that difference is your bank's, not ours.
We are not registered for GST. No GST is charged on our prices or included in them.
We can change prices at any time. A change never applies to an order already placed.
5. Orders
An order is an offer to buy. It is accepted when we dispatch it, not when you pay.
We may cancel and refund an order in full if:
- the item is out of stock
- the price or description was wrong
- we cannot verify the payment or the delivery address
- we have reason to think the order is fraudulent or for resale
If we cancel, you are refunded in full and you owe us nothing.
We can also limit quantities per person, per household, or per order.
6. Promotions and codes
Discount codes. One code per order unless we say otherwise. Codes cannot be combined with each other, cannot be applied to an order already placed, and have no cash value.
Sales. A reduced price applies for as long as we say it applies. If you bought at full price shortly before a sale, the difference is not refundable.
The promo program. Anyone can take part. You pick five pieces, you get a code to share, and when five separate people buy with it your five pieces ship to you free.
How it runs:
- You choose five pieces in your sizes and we hold them for you. Nothing is charged and nothing ships at that point.
- You name your code. It gives whoever uses it 10% off.
- When five separate customers have bought using it, your five pieces ship to you, postage included.
The conditions:
- Five separate customers. Several orders from the same person count once.
- You cannot use your own code on your own order.
- Refunded or cancelled orders do not count toward the five.
- Your pieces ship once the 30 day return window has closed on the qualifying orders.
- Your picks are held for 90 days from the day you choose them. If something sells out before you finish, you swap it for a piece of the same value.
- Sizes are fixed at the moment you pick.
- If you post about us using your code, mark the post as an ad or a paid partnership. It is a legal requirement in Australia and it protects both of us.
- We can close a code being used dishonestly. You will hear it from us directly and with a reason.
7. No contract and no employment
Taking part in a promotion does not make you an employee, a contractor, an agent, or a partner of Chrome Drxp. It does not create a contract of employment or engagement between us.
You are not obliged to post anything, to sell anything, or to keep going. You can stop whenever you like and you owe us nothing for it. Equally, we do not owe you a wage, a commission, a minimum number of sales, or continued access to any promotion.
We can change or end a promotion at any time. If you have already met the conditions when we do, we honour what you have earned. That part is not at our discretion.
8. Age
You must be at least 16 to place an order. If you are under 18, you need permission from a parent or guardian.
9. Delivery, risk and customs
Until it reaches you, it is ours. If an order is lost in transit, or arrives damaged, that is on us. We will replace it or refund you. We deal with the carrier ourselves and you do not have to.
Import duties and taxes are yours. Orders ship internationally from China and may attract duties, taxes, or a customs handling fee when they arrive in your country. Those are set by your country, they are not ours, and they are not included in what you paid us. The carrier will contact you if anything is owed.
Delays. Customs holds, carrier backlogs, weather and peak periods move delivery dates and none of them are within our control. We will chase anything running past its estimate rather than repeat the estimate back to you. A delay on its own is not usually grounds for a refund. But if an order runs so far past its estimate that it has not been supplied within a reasonable time, the consumer guarantees apply and we will refund you. An order that never arrives is covered above.
Refused or abandoned parcels. If you refuse delivery, or a parcel is returned to sender or destroyed because import charges went unpaid, we cannot refund it.
Wrong addresses. Check your address at checkout. If an order goes astray because the address you gave us was wrong or incomplete, that is not refundable. Tell us before it ships and we will fix it for free.
10. Accounts
If you make an account, keep your password to yourself. You are responsible for what happens under it. Tell us if you think someone else has access.
11. Third-party links
The site links out to other places, including our social accounts and carrier tracking. We do not control those and we are not responsible for them.
12. Where we are not liable
Nothing here limits your rights under the Australian Consumer Law or any other law that cannot be excluded by agreement. The returns policy sets out those guarantees and they apply regardless of anything in this section.
Beyond that, and to the extent the law allows, we are not liable for indirect or consequential loss, and our total liability for any order is limited to what you paid for it.
13. Governing law
These terms are governed by the laws of Australia.
14. Changes
We can update these terms. The version on the site when you place an order is the version that applies to that order.
